Je suis très contyent que Cécile ait soulevé ce point, car il me pose, à moi aussi, problème.
En effet, j'envisageais de lire un texte contemporain disponible sur feedbook, mais la licence me pose problème. En particulier, comme Cécile, la notification ND, qui signifie
“Pas de modifications — Dans le cas où vous effectuez un remix, que vous transformez, ou créez à partir du matériel composant l'Oeuvre originale, vous n'êtes pas autorisé à distribuer ou mettre à disposition l'Oeuvre modifiée.”
La question étant de savoir si une lecture audio constitue une modification.
Je serais tenté de dire non, car le site anglais de CC est plus précis sur le sujet :
“When is my use considered an adaptation?
Whether a modification of licensed material is considered an adaptation for the purpose of CC licenses depends primarily on the applicable copyright law. Copyright law reserves to an original creator the right to create adaptations of the original work. CC licenses that allow for adaptations to be shared—all except BY-ND and BY-NC-ND—grant permission to others to create and redistribute adaptations when doing so would otherwise constitute a violation of applicable copyright law. Generally, a modification rises to the level of an adaptation under copyright law when the modified work is based on the prior work but manifests sufficient new creativity to be copyrightable, such as a translation of a novel from one language to another, or the creation of a screenplay based on a novel.
Under CC licenses, synching music in timed relation with a moving image is always considered an adaptation, whether or not it would be considered so under applicable law. Also, under version 4.0, certain uses of databases restricted by sui generis database rights also constitute adaptations (called “Adapted Material” in the 4.0 licenses), whether or not they would be considered adaptations under copyright law. Note that all CC licenses allow the user to exercise the rights permitted under the license in any format or medium. Those changes are not considered adaptations even if applicable law would suggest otherwise. Donc, en gros, une “adaptation” est considérée comme une modification à partirdu moment où l'adaptation serait susceptible de recevoir un nouveau copyright. Une traduction est une modification. Une adaptation de roman en pièce aussi.
L'important est qu'il est clairement précisé qu'un changement de format n'est PAS une modification. (ex. distribuer un livre numérique sous forme papier n'est pas considéré comme une modification)… Par extension, on pourrait considérer que le passage du format écrit au format audio n'en n'est pas une non plus.
Reste le problème de l'ajout de musique ou d'effet sonore, qui semble bien par contre rentrer dans la case “modification”.
Bref, je reste asse perplexe sur cette mention ND. J'aimerais savoir si d'autres DDV ont rencontré ce problème, et ce qu'ils en ont fait.
(personnellement, je pense contacter directement l'auteur, histoire d'obtenir son autorisation et de lever tout doute, mais c'est effectivement un problème qui peut se reposer.)
(Enfin, dans mon cas ce n'est pas pour tout de suite. Ca attendra que je sois moins débordé.)
